Model Types & Legal Standing
TalentCastIQ offers three distinct model types, each with different legal standing and risk profiles for businesses:
π Real People with Consent (Best Option)
Licensed images of real talent who have provided explicit, documented consent for your specific project. This is the lowest-risk option for companies concerned about legal liability. Each usage requires individual talent approval, and all consent is verified and recorded. Ideal for brands prioritizing full legal protection and authentic representation.
β AI-Generated Variants (Second Best Option)
AI-generated alternate versions of real talent (different hair, eye color, body type, etc.). Variants provide lower legal risk than fully AI-generated characters while offering creative flexibility. Talent retains approval rights for variant licensing. A balanced option combining the authenticity of real people with the safety of AI generation.
β οΈ AI-Generated Characters (Higher Risk β Data Sheet Provided)
Fully AI-generated fictional characters created entirely by the platform. These images carry inherent and greater legal risk due to the synthetic nature of the content, potential regulatory requirements (including AI disclosure laws), and unpredictability of AI-generated outputs.
By licensing AI-generated characters, you expressly acknowledge and agree that:
- You assume all liability β legal, financial, regulatory, and reputational β for any and all imagery generated.
- TalentCastIQ does not indemnify you β the customer bears full responsibility for all claims, damages, losses, penalties, or legal actions arising from your use or distribution of AI-generated character images.
- TalentCastIQ will provide a Character Data Sheet (CastCard document) with prompt details, generation parameters, and metadata proving the image is AI-generated and does not depict a real person β this serves as your evidentiary record, not a guarantee of safety or compliance.
- You are solely responsible for compliance with all AI disclosure laws, regulations, and labeling requirements in every jurisdiction where the content is published.
- TalentCastIQ provides no warranty that AI-generated content is safe, legally compliant, or free from risk.
Recommendation: For maximum legal protection and peace of mind, real people with consent and AI variants are the preferred model types. AI-generated characters should only be used by businesses with legal counsel and full understanding of the risks involved.
TalentCastIQ Is Not Held Liable β Imagery Platform Only
TalentCastIQ is a platform that provides imagery and facilitates the licensing of likeness through documented consent and approval. We do not indemnify, defend, or hold harmless any customer β whether business or talent β from claims, damages, losses, or legal actions arising from the use of any licensed assets, regardless of model type. Our role is to provide the imagery and the tools for customers to reduce their risk: documented talent consent, usage approval records, and CastCard Data Sheets containing prompt details, generation parameters, and provenance metadata. These serve as evidentiary records of the asset's origin and the consent framework under which it was licensed β but they do not constitute a guarantee of safety, compliance, or legal protection, and TalentCastIQ assumes no liability for how assets are ultimately used. The customer assumes all liability for their use of platform assets.
1. Agreement to Terms
By accessing or using TalentCastIQ, you agree to be bound by these Terms and Conditions. Both Talent and Business users must accept these terms before participating in any transactions on the platform.
2. Talent Terms
As a Talent user, you acknowledge and agree that:
- You will receive compensation for project-based usage of your images for AI that could appear on commercial sites, including large retailers, brands, marketing materials, and campaigns.
- You must approve every usage request before your likeness can be used by any business.
- All uploaded assets will be watermarked with the TalentCastIQ watermark until they are purchased and downloaded by an approved business.
- You are responsible for setting your own pricing tiers (project-based, yearly, and lifetime).
- You must sign the physical consent form acknowledging these terms.
- You may revoke consent for future projects at any time, but previously approved and paid projects remain valid.
3. Business Terms & Project Lifecycle
As a Business user, you acknowledge and agree that:
- You must apply for and receive approval from TalentCastIQ before accessing talent profiles.
- You must submit a valid business license and pass our review process.
- You may only use licensed assets for the specific project described in your usage request.
- Usage beyond the approved scope requires a new request and approval from the talent.
- All assets are watermarked until payment is completed and cannot be used in their watermarked form.
- Upon conclusion of your campaign or project, you are legally required to return to your dashboard, upload the final campaign assets (renders, screenshots, or published materials showing how the talent's likeness was used), and mark the project as complete. Failure to do so constitutes a breach of your license agreement and may result in account suspension and legal action.
Mandatory Project Lifecycle β All Business Licenses
Every project-based license on TalentCastIQ follows a strict four-stage lifecycle. Compliance with all stages is a condition of your license and these Terms.
- Request & Approval. You must submit a usage request detailing the project name, a full description of how the talent's likeness will be used, the intended platforms, and the pricing tier. The talent must individually approve your request before any license is granted. Requests without sufficient detail will be denied.
- Payment & Asset Download. Upon talent approval, you must complete payment for the selected pricing tier before any assets are accessible. Assets are only available in unwatermarked form after verified payment. Downloaded assets are licensed solely for the approved project and no other purpose.
- Project Completion & Image Upload (Mandatory). Upon conclusion of the campaign, you are legally required to return to your dashboard, locate the project, and mark it as complete by uploading the final campaign images (renders, screenshots, or published materials showing how the talent's likeness was used). These images are permanently retained as part of TalentCastIQ's legal record and are accessible to the talent whose likeness was used. Failure to complete this step constitutes a breach of your license agreement.
- Re-Licensing for New Use. Each license is valid only for the single project approved by the talent. If you wish to use the same talent's likeness for a new campaign, advertisement, product line, or any other purpose β including a continuation or extension of a prior project β you must submit a new usage request, obtain new talent approval, and purchase a new license. Continued use of previously licensed assets beyond the approved scope without re-licensing is a material breach of these Terms and may result in legal action.
Breach & Enforcement
Any use of licensed assets outside the approved project scope, failure to upload completion images, or re-use without a new license constitutes a material breach. TalentCastIQ reserves the right to immediately suspend your account, revoke all licenses, and pursue legal remedies including damages on behalf of the affected talent. All project records β including usage descriptions, downloaded assets, and completion images β are permanently retained for evidentiary purposes.
4. Minor Talent (Children)
If a talent is under the age of 18, their account must be managed by a parent or legal guardian. The parent/guardian must accept all terms on behalf of the minor and sign the physical consent form. All earnings and approvals are managed through the parent/guardian account.
5. Consent & Physical Agreement
All participants (talent, parents/guardians, and businesses) are required to print, sign, and upload a physical consent form that states:
"I, the undersigned, agree that I will receive compensation for project-based usage of my images for AI applications that could appear on commercial sites, including but not limited to large retailers, brands, marketing materials, and advertising campaigns. I acknowledge that I must approve each usage request before my likeness can be used, and that all assets will bear the TalentCastIQ watermark until they are purchased and downloaded by an approved business."
6. Identity Verification & ID Photo Requirement
As part of the registration process, all Talent users are required to complete identity verification by submitting a photo of themselves holding a valid, government-issued photo ID (such as a driver's license, national ID card, or passport) clearly visible in front of them. By registering, you agree to the following:
- You must take and upload a clear photo of yourself holding your government-issued photo ID during the onboarding process. The ID and your face must both be clearly visible in the image.
- This photo will be securely stored in TalentCastIQ's database as your identity verification record.
- You consent to TalentCastIQ retaining this photo for as long as is necessary for legal, compliance, and verification purposes, including but not limited to: verifying your identity, resolving disputes, complying with applicable laws, and protecting the rights of all platform participants.
- TalentCastIQ will not share your ID photo with any third party except where required by law or court order.
- Submitting a fraudulent, altered, or third-party ID is strictly prohibited and may result in immediate account termination and referral to the appropriate authorities.
- Registration cannot be completed without a valid ID verification photo. Accounts without a verified ID photo will not be approved.
7. AI-Generated Variants & TalentCastIQ Ownership
When a Talent user generates one or more AI-generated variant profiles through the TalentCastIQ platform (including variations of hair color, eye color, body type, ethnicity, or any other appearance attribute), the following terms apply:
- All AI-generated variant images and character sheets created on the TalentCastIQ platform constitute new and distinct intellectual works that are fundamentally different from the original photographs. Each variant is a separate creation, not the same person, and is therefore owned exclusively by TalentCastIQ.
- Because variants are different versionsβmodified representations with altered appearance attributesβthey are treated as original works created by the platform and are not derivative of the talent's likeness in their new form.
- TalentCastIQ retains full, irrevocable, perpetual, worldwide rights to use, reproduce, distribute, display, and commercially exploit all generated variant images without further permission or compensation.
- Permitted uses by TalentCastIQ include, but are not limited to: marketing and advertising, e-commerce product imagery, platform development and demonstration, packaging design, brand campaigns, promotional materials, and any other commercial or promotional purpose.
- Talent users acknowledge that by generating a variant, they explicitly consent to and assign all intellectual property rights in those variants to TalentCastIQ.
- Talent users waive any claim of ownership, right of publicity, or compensation related to TalentCastIQ's use of generated variants, as these are distinct works owned by the platform.
- Businesses may still request and license variants from talent listings, subject to the standard usage request and payment process; such business licenses do not diminish TalentCastIQ's ownership rights.
Platform-Initiated Variants
TalentCastIQ reserves the right, at its sole discretion, to create additional AI-generated variants of any registered talent profile at any time and for any reason β including but not limited to platform growth, marketplace diversity, business client requests, and demonstration purposes. All such platform-initiated variants are created and owned exclusively by TalentCastIQ. By registering as a Talent user and uploading your reference photos and CastCard, you grant TalentCastIQ a perpetual, irrevocable, royalty-free, worldwide license to generate, own, and commercially exploit any number of variants derived from your registered profile. Talent users are not entitled to compensation, approval rights, or prior notice with respect to variants created at TalentCastIQ's discretion.
8. Pricing Tiers
- Project-Based: One-time fee for a specific project. Usage rights expire when the project concludes.
- Yearly: Annual license fee for ongoing usage rights. Must be renewed each year.
- Lifetime: One-time fee for perpetual usage rights for the agreed-upon purposes.
9. Payment Split & Revenue Sharing
TalentCastIQ operates on a 70/30 revenue split model. After all applicable taxes, payment processing fees, and transaction costs are deducted:
- The Talent creator receives 70% of the net payment amount.
- TalentCastIQ retains a 30% commission fee.
- This split applies to all pricing tiers: project-based, yearly, and lifetime licenses.
- Talent earnings are paid out according to the payment schedule specified in your account settings.
10. Watermark Policy
All talent assets displayed on TalentCastIQ are protected with a visible watermark. Watermarks are only removed upon completed payment and download by an approved business with talent consent. Any unauthorized removal or use of watermarked assets is strictly prohibited.
11. AI Disclosure Laws & Regulatory Compliance β Business Liability
Laws and regulations governing AI-generated imagery, synthetic media, and digital likeness are evolving rapidly at the federal, state, and local levels. It is the sole responsibility of each Business user to understand, monitor, and comply with all applicable laws in every jurisdiction where their campaign, advertisement, or content is published, distributed, or displayed.
New York AI Disclosure Law β Effective August 2025
New York law (and similar legislation in other jurisdictions) requires that AI-generated images depicting individuals β including AI-generated likenesses of models β be clearly labeled as AI-generated in any commercial context, including advertising, marketing materials, product imagery, and digital publications. Business users who distribute or publish content derived from TalentCastIQ assets in New York, or targeting New York audiences, are solely responsible for ensuring compliance with these labeling requirements and any other applicable disclosure obligations.
- TalentCastIQ is not liable for any Business user's failure to comply with AI disclosure, labeling, or synthetic media laws β including but not limited to the New York law effective August 2025, any equivalent state or federal legislation, or any international regulations governing AI-generated content.
- By purchasing a license and downloading assets, Business users expressly acknowledge that compliance with all applicable AI disclosure and labeling laws is their exclusive responsibility.
- Business users agree to indemnify, defend, and hold harmless TalentCastIQ, its officers, directors, employees, and affiliates from any claims, penalties, fines, damages, or liabilities arising from the Business user's failure to comply with any AI disclosure or labeling requirement.
- TalentCastIQ makes no representation or warranty that use of its assets in any specific jurisdiction will be compliant with local, state, federal, or international law. It is the Business user's obligation to obtain independent legal counsel regarding applicable requirements before publishing any AI-generated content.
- This limitation of liability applies regardless of whether TalentCastIQ had or should have had notice of the applicable law or regulation.
12. Platform Role, Business Liability & CastCard Data Sheets (All Talent Types)
TalentCastIQ is an imagery platform that provides assets across all model types β real people with consent, AI-generated variants, and AI-generated characters β each accompanied by CastCard documentation and, where applicable, consent records. TalentCastIQ is not held liable for how any licensed asset is used. Our platform provides the imagery and a framework for customers to reduce their risk: documented consent from real talent, explicit usage approval records, and CastCard Data Sheets documenting each asset's origin, attributes, and provenance. These tools help customers demonstrate that likeness was licensed through proper channels β but TalentCastIQ itself assumes no liability and does not indemnify, defend, or hold harmless any customer from claims, damages, losses, or legal actions arising from the use of any licensed asset, regardless of model type.
TalentCastIQ Is Not Held Liable β Customer Assumes All Liability
TalentCastIQ is an imagery platform. We provide assets and the tools β documented consent, usage approvals, CastCard Data Sheets β that enable customers to reduce their risk by demonstrating proper licensing of likeness. We make no representation, warranty, or guarantee that any asset β whether depicting a real person with consent, an AI-generated variant, or a fully AI-generated character β is safe, compliant, or free from risk when used in any commercial context, including but not limited to advertising, product packaging, social media, broadcast, print, or any other medium. TalentCastIQ does not and cannot guarantee that any licensed asset will not generate controversy, public backlash, legal claims, regulatory action, or reputational harm. The Customer assumes all liability β financial, legal, reputational, and otherwise β for any and all consequences arising from the download, use, publication, or distribution of any asset obtained through the platform. TalentCastIQ expressly is not held liable and does not indemnify, defend, or hold harmless any customer for any reason.
- Customer bears full responsibility. By downloading or licensing any asset from TalentCastIQ, the Customer (whether business or talent) expressly agrees that TalentCastIQ, its officers, employees, affiliates, and creators shall bear no liability whatsoever for any claims, damages, losses, penalties, or legal actions arising from or related to the Customer's use of such assets.
- No guarantee of legal or regulatory compliance. TalentCastIQ does not warrant that any asset complies with the laws, regulations, or industry standards of any jurisdiction. It is the Customer's sole responsibility to verify and ensure compliance before use.
- No guarantee against third-party claims. TalentCastIQ does not warrant that any assets are free from claims of copyright infringement, right of publicity violations, defamation, or any other third-party intellectual property or personal rights claims. The Customer assumes all risk in this regard.
- Customer indemnifies TalentCastIQ. Customers agree to indemnify, defend, and hold harmless TalentCastIQ, its officers, directors, employees, affiliates, and creators from and against any and all claims, demands, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to the Customer's download, use, publication, or distribution of any asset obtained through the platform.
CastCard Data Sheets β Evidentiary Record for All Talent Types
For all model types β real people with consent, AI-generated variants, and AI-generated characters β TalentCastIQ provides a CastCard Data Sheet (also referred to as a CastCard document or character attribute sheet). The contents vary by model type but serve a common purpose: to provide Customers with documentation of the asset's origin, attributes, and provenance. These data sheets are the platform's official evidentiary record and are provided as a service to Customers β they do not constitute legal advice, a guarantee of safety, or an assumption of liability by TalentCastIQ.
- Real People with Consent. Data sheets include the talent's consent records, physical attributes, reference photo metadata, and project approval documentation β serving as proof of explicit, documented consent for the specific licensed use.
- AI-Generated Variants. Data sheets include the variant's generation parameters, modified attributes, reference to the original talent profile, and the prompt and seed data used β serving as documentation of the variant's synthetic origin while linking to the underlying consent framework.
- AI-Generated Characters. Data sheets include the full prompt, generation parameters, character attributes, seed data, and metadata for all panel images β proving the image is fully AI-generated and does not depict any real person.
- Mandatory safe-keeping. Customers who license assets from TalentCastIQ are required to also download and retain the corresponding CastCard Data Sheet for the full duration of their use of the licensed assets, and for a minimum of seven (7) years following the conclusion of the licensed project.
- Proof of origin. The CastCard Data Sheet is the official evidentiary record for the licensed asset. In the event of any legal, regulatory, or public inquiry regarding the origin of the asset, the Customer must produce the corresponding data sheet to establish the nature and provenance of the content.
- Failure to retain. Failure to download, retain, or produce the CastCard Data Sheet upon request may expose the Customer to legal liability. TalentCastIQ bears no responsibility for any consequences arising from a Customer's failure to maintain the data sheet.
- Modifications void data sheet accuracy. Any modifications, alterations, edits, or manipulations of the licensed assets β including but not limited to changes to facial features, body attributes, coloring, composition, or any other visual element β may cause the asset to diverge from the original parameters documented in the CastCard Data Sheet. Once modified, the data sheet may no longer accurately describe the asset, and TalentCastIQ makes no representation as to the provenance, safety, or legal status of any modified or derivative work. The original data sheet applies only to the unmodified asset as downloaded from the platform; Customers who alter assets do so at their own risk and assume full liability for any consequences arising from such modifications.
- Data sheet availability. CastCard Data Sheets are available for download from the talent or character detail page on the TalentCastIQ platform at the time of license purchase and remain accessible in the Customer's dashboard under completed projects for the duration of account activity.
13. GDPR Compliance & Data Privacy

- We only collect and process personal data necessary for platform operations, identity verification, legal compliance, and fraud prevention.
- Users have the right to access, correct, or request deletion of their personal data, subject to applicable legal retention requirements.
- We do not share personal data with third parties except where required by law, court order, or with explicit user consent for specified purposes.
- All data processors and third-party service providers are bound by Data Processing Agreements that ensure GDPR compliance.
